Most mobile devices allow you to control or disable the use of location services in the device’s settings menu. We use a combination of publicly available IP to Geoinformation databases as well as requesting your browser for your current Geolocation information (Latitude, Longitude, City, State) for the sole purpose of tailoring your experience of our Site and Services. We may store this information in a cookie in order to have it accessible when you return and jump directly to your local area. Parts of the Circa 420 Site use Google Maps/Earth services, including the Google Maps API(s). 9. Sharing & Disclosure

Circa 420 lets you publish information that is visible to the general public. For example:

• Parts of your public profile page, such as your first name, your description, and city, are publicly visible to others.

• Public Listing pages are publicly visible and include information such as the approximate location, Listing description, menus, brands, photos, videos, rating and reviews, events, products, and any additional information the Member chooses to share.

If you submit content in a public forum or social media post or use a similar feature on the Circa 420 Site, that content is publicly visible.

The information you share publicly on the Circa 420 Site may be indexed through third party search engines. We do not control the practices of third party search engines, and they may use caches containing your outdated information.

10. Investigations and Compliance with Law

Circa 420 may investigate and disclose your information to courts, law enforcement or governmental authorities, or authorized third parties, if and to the extent we are required to do so by law or if such disclosure is reasonably necessary: (i) to comply with legal process and to respond to claims asserted against Circa 420, (ii) to respond to verified requests relating to a criminal investigation or alleged or suspected illegal activity or any other activity that may expose us, you, or any other of our users to legal liability, (iii) to enforce and administer our Terms of Service or other agreements with Members, (iv) for fraud investigation and prevention, risk assessment, customer support, product development and debugging purposes, or (v) to protect the rights, property or personal safety of Circa 420, its employees, its Members, or members of the public.

11. Business Transfers

We may share information from or about you with subsidiaries, joint ventures, or other companies under common control, in which case we will require them to honor this Privacy Policy. If Circa 420 undertakes or is involved in any merger, acquisition, reorganization, the sale of assets, bankruptcy, or insolvency event, then we may sell, transfer or share some or all of our assets, including your information. Note that information that you have shared with others (like Reviews or forum postings) may continue to be publicly visible on the Circa 420 Site in association with your first name, even after your Circa 420 Account is canceled.

15. Your California Privacy Rights: Notice to California Customers

Subject to certain limits under California Civil Code § 1798.83, if you are a California resident, you may ask us to provide you with (i) a list of certain categories of personal information that we disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year and (ii) the identity of third parties that received personal information from us for their direct marketing purposes during that calendar year. The list will not be specific to disclosures your particular personal information. 16. Children’s Privacy 

Circa 420 does not knowingly collect personally identifiable information from persons under the age of twenty-one (21). The privacy of children is of the utmost importance and we are committed to complying with the Children’s Online Privacy Protection Act (COPPA). If we ever discover that we have inadvertently collected such information on anyone under the age of twenty-one (21), we will take necessary steps to ensure that such information is deleted from our systems database as soon as possible. The Internet is not a 100% secure environment so we can’t guarantee the security of the transmission or storage of your information. Circa 420 reserves the right to modify this Privacy Policy at any time in accordance with this provision. If we make changes to this Privacy Policy, we will post the revised Privacy Policy on the Circa 420 Site and update the “Last Updated” date at the top of this Privacy Policy. If you disagree with the revised Privacy Policy, you may cancel your Account. If you do not cancel your Account, your continued access or use of the Circa 420 Site will constitute acceptance of the revised Privacy Policy. If at any point in time, Circa 420 decides to make use of any personally identifiable information on its database, in a manner strikingly different from that which was stated when this information was originally collected, the user or users shall be promptly notified by email and shall have the option as to whether or not to permit the use of their information in this separate manner.
